UNITED BUSINESS MEDIA LLC WINS CIVIL DISPUTE IN SHANGHAI

 SHANGHAI — November 29, 2010 — United Business Media LLC (UBM) ended a two-year dispute with the defendants Publishers Association of China Game Publication Committee (CGPA) and Beijing Howell International Trade Fair Co. Ltd. (Howell) with regards to UBM’s Game Developers Conference™ China after the Shanghai Lu Wan District People’s Law Court, People’s Republic of China, handed down a first instance judgment in UBM’s favor on November 16, 2010. 

 In summary, pursuant to Articles 2, 9(1) and 14 of the PRC Anti-Unfair Competition Law, the Shanghai court held, amongst other things, as follows:-

1. CGPA shall immediately stop its unfair competition act in requesting its members not to participate in UBM's GDC China 2009 conference.

2. CGPA shall immediately stop its act of commercial slander against UBM, the same of which is regarded as an act of unfair competition.

3. CGPA shall immediately stop its false promotion, the same of which is regarded as an act of unfair competition. CGPA was only a supporting organization of GDC China 2007 and was not an organizer. Its notices to its members, in which it referred itself as an organizer, were without any factual basis.

4. Howell shall immediately stop its acts of unfair competition against UBM. The court held that although Howell knew the CGPA was not an organizer of the GDC China 2007, it still disseminated the CGPA’s notice originally addressed to its members, to a non-member, Shanghai Lian Xian Tang, and thereby amplifying the harmful effects of the unfair competition acts of CGPA.

5. CGPA shall issue a statement within 10 days from the effective date of the judgment (the statement requiring the approval of the court) for a consecutive 48 hours on the front page of the website <www.cgigc.com.cn> to publicly eliminate the effects of its acts.

6. Howell shall issue a statement within 10 days from the effective date of the judgment (the statement requiring the approval of the court) to Shanghai Lian Xian Tang to eliminate the effects of its acts.
